Auction of the Properties of Mathias Laimer, Innkeeper at the Löwen in Rabland

Auction Edict.

By the Imperial-Royal District and Criminal Investigation Court of Meran, the voluntary auction requested by Mathias Laimer,

innkeeper at the Löwen in Rabland, of the real estate belonging to him and described below, is hereby granted:

I. According to the tax cadastre of the municipality of Partschins No. 1180:

A. An inn building with outbuildings and ancillary structures, designated No. 1031, at the Löwen in Rabland; furthermore

B. two cabbage gardens measuring 349 fathoms,

C. the home meadow plot («Hausangerle») measuring 459 fathoms,

D. an open arable field measuring 2370 fathoms,

E. the meadow known as Pfaffegandwiese measuring 3051 fathoms,

F. a designated tract («Sondermarch») or mountain woodland, covered with larch, Scots pine, and birch, as well as oak, measuring 1544 fathoms, and

G. a mountain woodland, covered with oak, measuring 1544 fathoms.

To this belongs the right to drive and summer 5 cows on the Zühleralpe and Mutteralpe.

Over this, the formerly sovereign, now princely Thurn and Taxis Revenue Office of Meran holds manorial lordship, to which must be rendered annually as ground rent 2 fl. 32¾ kr., 1 hen, 10 eggs, 1 kid goat, 2 harvest chickens, and 7¼ kr. in pasture dues («Grasgeld»).

Furthermore, the parish benefice of Partschins collects annually in grain tithe («Sackzehent») 2¼ Star of rye, and Mr. v. Wiesenegg collects 4½ Star of rye.

And in constituted interest, 2 fl. to the parish church of Allgund, and oil amounting to 1 Gitten 2 Maß 1 Fraggl to the parish church of Partschins.

Finally, tax payable in three installments at the 21 fl. standard: 5 fl. 58 kr. 5⅕ Perner.

The starting bid for this is fixed in Viennese Currency at 3600 fl.

II. According to the same tax cadastre No. 1181:

The meadow Wörthwiese measuring 10920 fathoms, over which Mr. Peter Paul v. Menz holds manorial lordship, entitled to collect annually 4 fl. at the 21 fl. standard as ground rent.

Pays tax in three installments at the 21 fl. standard: 4 fl. 51 kr. 1⅘ Perner.

And No. 1182, the clearing field RautHacker, adjacent to the aforementioned Wörthwiese, measuring 772 fathoms, which owes 6 kr. ground rent to the princely Thurn and Taxis Revenue Office in Meran, and tax in three installments at the 21 fl. standard of 28 kr. 1 Vierer 6 9/10 Perner.

The starting bid for this is fixed in Viennese Currency at 3000 fl.

III. According to the tax cadastre of Naturns Cat. No. 720:

A portion of the Gröbengut estate in Plaus, from which on 26 February 1824, Folio 212, the housing share Lit. A was sold to the holder of the remaining dwelling, of which there still remains:

B. the arable field Gröbenacker measuring 8883 fathoms,

C. a hay meadow («Furhwiese») measuring 3906 fathoms,

D. the meadow Stoclmooswiese measuring 9819 fathoms,

E. the meadow Ruttmooswiese measuring 6805 fathoms.

To this belongs the entitlement to alpine, communal, and shared pasture rights on an equal footing with others.

Over this, the Meran Hospital holds manorial lordship, to which must be delivered annually as ground rent directly to Meran 26 Star of rye, 19 Star of fodder (new measure), and 2 harvest chickens.

Furthermore, there must be rendered annually to the princely Thurn and Taxis Revenue Office of Meran 12 kr. in pasture dues, to Mrs. Theresia Moosmiller in Meran with delivery as far as Plaus 6 Star of fodder, to the Holy Ghost Hospital of Meran with delivery on site 4 Star of rye and 3 Star of fodder, and in tax across three installments at the 21 fl. standard 1 fl. 14 kr. 1 Vierer, 8 Perner; by contrast, according to the deed of sale of 26 February 1824, Folio 212, the owner of the remainder of the Gröbengut must contribute 2 kr. each time across the three tax installments.

The starting bid for this is fixed at 3000 fl. Viennese Currency.

IV. According to the tax cadastre of Partschins No. 1243:

The meadow Grillbodenwiese measuring 7644 fathoms, from which, however, a portion was previously alienated according to a deed of sale of 23 November 1801.

Over this, the estate of the Counts of Stachelburg holds manorial lordship and collects annually 3 kr. in tithe interest («Theilzins»).

The starting bid for this is fixed in Viennese Currency at 1600 fl.

V. According to the purchase of 9 February 1836, p. 176:

A parcel of meadowland measuring 3 old Tagmahde, situated on the Plausermoos and planted with willow trees («Felberbäume»), which was allotted to the Gräberhof on 23 October 1771.

Over this, the princely Thurn and Taxis Revenue Office in Meran holds manorial lordship, to which 3 kr. W. W. T. N. in ground rent must be paid annually for each Tagmahd.

The starting bid for this is fixed in Viennese Currency at 750 fl.

Conditions.

1. The sale of all properties is made ad corpus with all appurtenant rights, as well as with the assumption of all known and unknown encumbrances of any kind resting thereon, which the buyer must assume and discharge from the day of the auction onward as they are demanded, without regard to their origin or title.

2. The buyer alone, without recourse against the seller, must bear the costs of the edict, auction, deed execution, and issuance, as well as the poor percentage, transfer fees, and other change-of-ownership duties.

3. The buyer of the inn property No. 1 must take over at the appraisal value all movable furnishings and utensils that the seller does not reserve for himself; an assumption of debt bearing interest from Candlemas of the current year, carrying the relevant interest rates and enforcement rights of the transferred debts, will be charged against the resulting appraisal amount and the sale proceeds of all properties; the remaining balance due to the seller shall likewise bear annual interest at four percent from Candlemas of the current year and is to be paid in cash upon six months' notice of termination.

4. Following the close of the auction, no higher subsequent bids will be accepted. Risk and peril regarding the auctioned properties pass to the buyer from the day of the auction, and the buyer must provide trust-grade security for one-third of the purchase price; failing this, a further auction shall be permitted at his risk, loss, and expense.

5. The buyer of property No. 1 must grant to the seller's sister, Katharina Laimer, the lifelong and gratuitous use of the entire so-called roadkeeper's cottage («Wegmacherhäuschen»); should she choose not to reside in it herself, she shall also be entitled to lease it out to third parties.

6. The seller reserves for himself and his family, out of the properties offered under No. 1, gratuitous use for three years of: half of the summer stable and half of the threshing barn above it facing the highway, as well as the small stable underneath the roadkeeper's cottage; and

7. the buyer of property No. 1 must likewise provide trust-grade security for the full value of the inventoried movable items received.

8. The auction itself will take place on 21 May of this year at 1:00 p.m. at the Löwenwirth tavern in Rabland, in accordance with the existing regulations.
