Opening of Bankruptcy Proceedings on the Estate of the Deceased Martin Kofler in Obermais

Auction Edict.

From the Imperial-Royal District and Criminal Investigation Court of Meran, it is made known through the present edict to all whom it may concern:

That the court has granted the opening of bankruptcy proceedings over all movable and immovable property located in the land of Tyrol and Vorarlberg belonging to the late Martin Kofler, Jobmann in Obermais.

Therefore, everyone who believes they are entitled to make a claim against the said debtor is hereby reminded to submit the notification of their claim by 4 February of the current year in the form of a formal lawsuit against the representative of this bankruptcy estate, Dr. Johann von Mörl, before this court without fail, and to demonstrate therein not only the accuracy of their claims, but also the legal basis by virtue of which they demand to be placed in this or that class, as otherwise, after the expiry of the designated day, no one will be heard further, and those who have not registered their claims by then shall be rejected with regard to all property of the named debtor located in the land of Tyrol and Vorarlberg without exception, even if they were actually entitled to a right of compensation, or had their own property to claim from the estate, or if their claim were registered on real estate of the debtor, such that any creditors who happen to owe debts to the estate shall be compelled to pay their debt regardless of any rights of compensation, ownership, or lien that might otherwise have stood in their favor.

At the same time, a hearing is scheduled for 6 February of the current year at 9 o'clock in the morning at the chancery of this District Court to attempt an amicable settlement of this bankruptcy matter and, should none be reached, for the confirmation or election of an estate administrator and a creditors' committee, as well as for determining other matters concerning this estate, at which all creditors are to appear all the more certainly, as those failing to appear will be considered to have agreed to the resolution of those present.
